Having read and considered Plaintiff's Request for Entry of Judgment and all supporting pleadings and exhibits submitted therewith already on file with this court; and good cause appearing therefor,
JUDGMENT IS HEREBY ENTERED in favor of Plaintiff AGREXCO (USA) LTD. ("Agrexco") and against Defendants JOHN BROWN & ASSOCIATES, INC.; JOHN A. BROWN, JR. AND KATHERINE BROWN, jointly and severally, in the principal amount of $34,000.00, all of which qualifies for trust protection under the trust provisions of Perishable Agricultural Commodities Act ("PACA") [7 U.S.C. § 499e, et seq.];
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the $34,000.00 sum under this judgment that qualifies for protection under the trust provisions of the Perishable Agricultural Commodities Act ("PACA") [ 7 U.S.C. § 499e, et seq.] is a non-dischargeable debt pursuant to Section 523(a)(4) of Title 11, United States Code;
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Agrexco shall be entitled to recover post-judgment interest at the rate of ten percent (10%) per annum on all sums due under this judgment until fully paid.
The Clerk shall enter judgment forthwith.
