STIPULATION AND ORDER TO DISMISS ACTION WITH PREJUDICE
The parties have reached a settlement of this action, payable by Defendant City of Oakland to plaintiff within 60 days. Pursuant to Federal Rules of Civil Procedure, Rule 41(a)(1)(ii), plaintiff, by and through his attorney, Miles Washington, and Defendants City of Oakland and Maximilliano Thomas (sued as Maxwell Thomas), by and through their attorney, R. Manuel Fortes, hereby stipulate to dismiss this action with prejudice, each party to bear its own costs.

ORDER

GOOD CAUSE APPEARING, the Court so orders that this action is dismissed with prejudice.
