Plaintiff, by its counsel, having advised the Court that the parties have agreed to a settlement of this action,

IT IS HEREBY ORDERED that this case is dismissed with prejudice provided, however, that if any of the parties certifies to this Court, within 90 days, with proof of service of a copy on opposing counsel, that the agreed conditions for settlement have not been fully performed, this Order will be vacated and this action will forthwith be restored to the calendar to be set for trial.

IT IS SO ORDERED.
