ORDER OF DISMISSAL

In an Order filed March 5, 2003, the court ordered Roderick Washington to pay the balance of the $150.00 filing fee no later than April 4, 2003 or this action would be dismissed. Immediate payment was required because Washington is a prisoner who has had three or more prior prisoner actions dismissed by the court and is ineligible to proceed in forma pauperis. See 28 U.S.C. § 1915 (g). Washington filed an application to proceed in forma pauperis, but as the court already explained, Washington is ineligible to proceed in forma pauperis because of his case filing history. Washington did not pay the filing fee and the deadline by which to do so has passed. Accordingly, this action is DISMISSED without prejudice to Washington filing a civil rights complaint for which he pays the full filing fee at the time of filing the complaint. The in forma pauperis application is DENIED. Because this action is now being closed, Washington should not file any more documents in it. The clerk shall close the file.
