SINGSON v. RIANDA

United States District Court, Northern District of California

April 23, 2003

RONALD W. SINGSON, PLAINTIFF,
v.
LINDA L. RIANDA, DEFENDANT.

The opinion of the court was delivered by: Thelton E. Henderson, United States District Judge

ORDER OF DISMISSAL

This action was opened on March 7, 2003, when Singson filed an in forma pauperis application. His in forma pauperis application was not accompanied by any complaint or petition, and he did not have any action pending against the defendant. On March 7, 2003, the court notified Singson that his action was deficient because he had not filed a complaint or petition with his in forma pauperis application and notified Singson that if he did not submit a complaint or petition within thirty days the action would be dismissed. Singson did not file anything in response to the court's notice and the deadline by which to file a complaint or petition has passed. Accordingly, this action is dismissed for lack of a showing of any subject matter jurisdiction. See Fed.R.Civ.P. 12(b)(1). The in forma pauperis application is DENIED. The clerk shall close the file. Because this action is now being closed, Singson should not file any more documents in it.

IT IS SO ORDERED.
