DAUGHERTY v. ROZET

United States District Court, Northern District of California

July 28, 2003

MARY DAUGHERTY, PLAINTIFF,
v.
BRUCE ROZET, U.S. DEPARTMENT OF HUD, BETHEL AME CHURCH, REV. J.E. BOYD CHARLES T. RAMSEY, ALTON MANAGEMENT CORP., THOMAS PAIN SQUARE, DEFENDANTS.

The opinion of the court was delivered by: William Alsup, United States District Judge.

DISMISSAL

On June 20, 2003, defendant Alton Management Corporation filed a motion to dismiss the complaint. Pro se plaintiff has not made a single appearance in this case since filing her complaint on June 6, 2002. Furthermore, because plaintiff passed away this past April, future appearances are not anticipated. While the Court regrets that plaintiff was not able to pursue her claim of housing discrimination, for the foregoing reasons, as well as the reasons stated in defendant's motion, the complaint is hereby DISMISSED. The Clerk shall CLOSE the file.

IT IS SO ORDERED.
