IN THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF CALIFORNIA

June 22, 2005

GREGORY LAND, MOVANT,
v.
UNITED STATES OF AMERICA, RESPONDENT.

ORDER DENYING MOVANT'S RULE 36 MOTION

Movant Gregory Land, a federal prisoner currently incarcerated at FCI Yazoo City, Mississippi, moves, purportedly pursuant to Federal Rule of Criminal Procedure 36, for an order correcting an alleged clerical error in his judgment and conviction order. Respondent opposes the motion. Having considered all of the papers filed by the parties, the Court DENIES Movant's Rule 36 motion.

BACKGROUND

On August 5, 1998, Movant was arrested and detained at the Solano County jail on a charge of manufacturing methamphetamine. While he was detained, Contra Costa County took Movant into custody on another unrelated methamphetamine charge. Movant was subsequently convicted of the latter charge in the Superior Court
