On November 8, 2004, Plaintiff CTC Real Estate Services filed
this interpleader action in the Superior Court of the State of
California in San Diego. On December 9, 2004, the United States
removed this action to the United States District Court. On
August 31, 2005, the United States, on behalf of the Internal
Revenue Service, filed a motion for summary judgment. The matter
is set for hearing on October 14, 2005, at 1:30 p.m. The
Court hereby ORDERS the following briefing schedule: 1. Any opposition to the motion shall be filed and served no
later than September 16, 2005.
2. Any reply shall be filed and served no later than September
3. Unless otherwise noticed, this matter shall be determined on
the papers submitted and without oral argument. CivLR 7.1(d)(1).
Accordingly, no appearances are required on October 14, 2005.
