The opinion of the court was delivered by: BARRY MOSKOWITZ, District Judge
STIPULATION FOR DISMISSAL OF DEFENDANTS FROM ENTIRE ACTION AND
WHEREAS, on or about July 27, 2005, this matter was resolved
between Plaintiff, BRAKE DEPOT SYSTEMS, INC., and Defendants,
WILLIAM F. ZIMMERER, JAMES POTTER and GOFORIT, INC. (hereinafter
collectively "the Parties") at mediation; and
WHEREAS, the Parties executed a Settlement Agreement and
Munual Release disposing of all claims between them regarding the
above-captioned litigation. IT IS HEREBY STIPULATED AS FOLLOWS:
Based upon the upon above-mentioned settlement, the Parties
hereby Stipulate and Agree that Defendants WILLIAM F. ZIMMERER,
JAMES POTTER and GOFORIT, INC. shall be dismissed from this
action with prejudice.
This stipulation may be executed via facsimile and in any
number of counterparts, all of which, when taken together, may be
considered as one document for the purposes of filing and/or
enforcement of this stipulation herein.
IT IS HEREBY ORDERED AS FOLLOWS:
Defendants, WILLIAM F. ZIMMERER, JAMES POTTER and GOFORIT, INC.
are hereby dismissed from this action with prejudice.
