The Early Neutral Evaluation Conference scheduled for September 16, 2005, was taken off calendar. The parties informed the Court that a settlement has been reached.

Therefore, a telephonic Settlement Disposition Conference will be held in this case on October 19, 2005, at 8:45 a.m., in the chambers of Magistrate Judge McCurine unless a signed stipulation for dismissal of this case is filed and a copy of the signed stipulation is provided to the chambers of Magistrate Judge McCurine, prior to that time. If a copy of a signed stipulation cannot be provided to the chambers of Magistrate Judge McCurine on or before the date indicated above, counsel shall contact the chambers of Magistrate Judge McCurine at least one court day before the date indicated above, to explain the reasons therefor. Monetary sanctions shall be imposed for failure to comply with this order. Counsel for plaintiff is instructed to initiate the call by first telephoning opposing counsel and then telephoning the Court at 619-557-6624.
