STIPULATION AND REQUEST FOR DISMISSAL ORDER THEREON
IT IS HEREBY STIPULATED, pursuant to a Settlement Agreement and
Release between Plaintiff, KENNETH J. MOSER, and Defendants, DANA
CAPITAL GROUP, INC. and NCO FINANCIAL SYSTEMS, INC., dated and
signed by Plaintiff on September 21, 2005, that this court enter
a dismissal with prejudice of Plaintiffs' complaint in the
above-entitled action pursuant to Fed.R.Civ.P. 41, with each
party to bear their own attorney's fees and costs.
The dismissal with prejudice shall dismiss the action in its
The Magistrate Judge shall retain jurisdiction over all
disputes among the parties arising out of the Settlement
Agreement and Release, including but not limited to
interpretation and enforcement of the terms of the above
referenced Settlement Agreement and Release.
ORDER ON STIPULATION FOR DISMISSAL
Having read the foregoing Stipulation, and good cause appearing
therefore, the Court GRANTS the Stipulation and dismissed the
above captioned action with prejudice.
