STIPULATION AND ORDER FOR DISMISSAL WITH PREJUDICE

IT IS HEREBY STIPULATED and AGREED, by and between the parties hereto through their respective counsel of record, that the above-entitled matter be dismissed, with prejudice pursuant to F.R.C.P. 41(a), all parties to bear their own fees and costs.

  The Magistrate Judge shall retain jurisdiction over all disputes between and among the parties arising out of the settlement agreement, including but not limited to interpretation and enforcement of the terms of the settlement agreement.

  Trial has not been set. ORDER FOR DISMISSAL WITH PREJUDICE

  Based upon the foregoing Stipulation by the parties and good cause appearing therefore, it is hereby

  ORDERED, ADJUDGED and DECREED that the above-entitled action be, and the same hereby is dismissed with prejudice, each party to bear its own costs incurred.

  IT IS FURTHER ORDERED that the Magistrate Judge shall retain jurisdiction over all disputes between and among the parties arising out of the settlement agreement, including but not limited to interpretation and enforcement of the terms of the settlement agreement.
