ORDER DISMISSING CASE IN ITS ENTIRETY

Before the Court is Plaintiff Hong Wei Xiao's Request for Dismissal. [Doc. No. 3.] Plaintiff filed suit with this Court on July 25, 2005. [Doc. No. 1.] To date, no answer has been filed by Defendant United States Department of Labor.

Subject to the provisions of Federal Rule of Civil Procedure 41(a)(2), a court may order the voluntary dismissal of an action at the plaintiff's instance. Accordingly, this Court DISMISSES the entire case without prejudice.

  IT IS SO ORDERED.
