ORDER GRANTING REQUEST FOR DISMISSAL

On September 20, 2005, Plaintiff Innfinity Software Copyright Company, LLC., filed a request for dismissal of the above captioned matter. Defendant never answered the complaint. Accordingly, Plaintiff is entitled to voluntarily dismiss the action pursuant to Fed.R.Civ.P. 41(a)(1). The case is hereby dismissed. As provided for in Rule 41(a)(1), the dismissal is without prejudice.

IT IS SO ORDERED.
