STIPULATION FOR DISMISSAL AND ORDER THEREON

WHEREAS, Petitioner desires to file a new N-400 naturalization application with the U.S. Department of Homeland Security, Citizenship and Immigration Services ("CIS");

  WHEREAS, CIS makes no representations or guarantees as to the outcome of Petitioner's N-400 application for naturalization, but agrees to exercise its best efforts to process Petitioner's new application on an expedited basis;

  IT IS HEREBY STIPULATED by the parties to this action, through their respective counsel, that this case be dismissed in its entirety without prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1)(II), each party to bear its own attorneys' fees and costs of suit.

  ORDER
