ORDER GRANTING FORFEITURE BY DEFAULT
WHEREAS, on April 28, 2005, the United States filed a Complaint
for forfeiture against defendant $27,158.00 in U.S. Currency.
WHEREAS, on May 3, 2005, the United States served Notice of
Complaint for Forfeiture and the Complaint for Forfeiture on the
following potential claimant:

WHEREAS, on May 13, 20, and 27, 2005, pursuant to Rule C(4),
Supplemental Rules for Certain Admiralty and Maritime Claims,
Federal Rules of Civil Procedure, notice was published in the
San Diego Commerce newspaper.
WHEREAS, from the time of said notice, no claim or answer has
been filed in this case. WHEREAS, on August 22, 2005, pursuant to the request of the
United States for Clerk's Entry of Default, the District Court
Clerk's Office entered a Default in this case.
WHEREAS, on September 30, 2005, the United States filed its
Notice of Motion and Motion for Judgment by Default to be heard
November 14, 2005. Potential claimant Kristopher Lytle, through
his counsel, was served notice of the Motion for Judgment by
WHEREAS, no responsive pleadings to contest the default have
THEREFORE, GOOD CAUSE APPEARING:
IT IS HEREBY ORDERED that judgment by default be entered
