STIPULATION FOR RELIEF FROM ENTRY OF DEFAULT AND DISMISSAL WITH PREJUDICE AND ORDER
WHEREAS, because of ongoing settlement negotiations that resulted in a complete and full settlement of this action, defendant Creditor Specialty Services, Inc. did not file a responsive pleading in this action; and

  WHEREAS, the Clerk of this Court, without any request for, or input from, plaintiff Wendy Lodge, entered default against Creditor Specialty Services for not filing a responsive pleading in a timely manner; IT IS HEREBY STIPULATED by and between the parties to this action that the default entered by the Clerk of this Court on October 6, 2005 against Creditors Special Service be vacated and that the above-captioned action be dismissed with prejudice.

  ORDER

  IT IS SO ORDERED that the default entered by the Clerk of this Court on October 6, 2005 against Creditors Specialty Service, Inc. be vacated and that this action be dismissed with prejudice.
