STIPULATION AND ORDER FOR DISMISSAL WITH PREJUDICE
The Parties herein, Plaintiff Douglas E. Barnhart ("Barnhart")
and Defendant deb Construction, Inc. ("DCI"), have resolved the
matters in dispute raised in this action without any admission of
liability. Accordingly, pursuant to Fed.R.Civ.P. Rule 41 (a)
(1) (ii), Barnhart and DCI hereby stipulate, by and through their
counsel of record and with the approval of this Court, to a
dismissal with prejudice of all claims in the above entitled
action. The parties agree to bear their own costs and attorneys'
The Parties having resolved their differences regarding the
matters in dispute, and upon the consent of the parties acting
through their counsel of record, IT IS HEREBY ORDERED that the
complaint in this action is hereby dismissed with prejudice. Each
party shall bear its own costs and attorneys' fees.
