STIPULATION FOR DISMISSAL AND ORDER THEREON
WHEREAS, the proper defendant in an action brought under the
Federal Tort Claims Act is the United States of America, not the
Transportation Security Administration;
WHEREAS, a Motion to Dismiss the Complaint as to the
Transportation Security Administration currently is set for
hearing on January 13, 2006 at 11:00 a.m.;
WHEREAS, Plaintiff and the United States of America desire to
settle this action;
IT IS HEREBY STIPULATED by the parties to this action that
the United States of America be substituted in place of the
Transportation Security Administration as the sole defendant in
IT IS FURTHER STIPULATED, pursuant to the terms of a separate
Settlement Agreement, that the above-captioned case be, and
hereby is, dismissed in its entirety with prejudice under Rule
41(a)(1)(ii) of the Federal Rules of Civil Procedure, with each
party to bear its own attorneys' fees and costs of suit. IT IS FURTHER STIPULATED that the Court shall retain
jurisdiction over all disputes between the parties relating to
the interpretation and enforcement of the settlement agreement.
