[PROPOSED] ORDER DENYING GRANTING MOTION BY THE SPECIAL LITIGATION COMMITTEE OF KLA- TENCOR'S BOARD OF DIRECTORS TO SHORTEN TIME FOR HEARING AND BRIEFING ON ITS MOTION FOR PROTECTIVE ORDER SETTING THE SCOPE OF DISCOVERY IN CONNECTION WITH ITS MOTION TO TERMINATE THE DERIVATIVE LITIGATION [Civ. L.R. 6-3]
The Special Litigation Committee of the Board of Directors of KLA-Tencor Corporation (the "SLC"), has moved this Court pursuant to Local Rule 6-3 for an order shortening the time for hearing and briefing on the SLC's Motion for Protective Order Setting the Scope of Discovery in Connection with Its Motion to Terminate the Derivative Litigation ("Motion for Protective Order").
Having considered the briefs and other documents and evidence submitted in support of and in opposition to the motion and having heard the arguments of counsel, and good cause appearing therefore
IT IS HEREBY ORDERED that:
1. The motion to shorten time by the SLC is DENIED. GRANTED.
2. The following schedule is set for briefing and hearing on the SLC's Motion for Protective Order:
(a) Any papers to be filed by Plaintiff in opposition to the SLC's Motion for Protective Order shall be filed and served by hand on or before Monday, April 7, 2008;
(b) Any reply papers to be filed by the SLC in further support of its Motion for Protective Order shall be filed and served by hand on or before Friday, April 11, 2008; and
(c) The hearing on the Motion for Protective Order shall be held on Tuesday, April 22, 2008, at 10:00 a.m., in Courtroom 2, located on the 5th Floor at United States District Court, 280 South 1st Street, San Jose, California.
