STIPULATION AND [PROPOSED ORDER] CONTINUING STATUS CONFERENCE Date: August 29, 2008 Time: 9:00 a.m.

IT IS HEREBY STIPULATED by and between the parties hereto through their respective counsel, ROBIN TAYLOR, Assistant United States Attorney, attorney for Plaintiff, and MATTHEW C. BOCKMON, Assistant Federal Defender, attorney for defendant, that the status conference now scheduled for August 15, 2008 be vacated, and a new status date of August 29, 2008 at 9:00 a.m. be set.

This continuance is requested due to the unavailability of counsel for Mr. McCormick.

It is further stipulated and agreed between the parties that the period beginning August 15, 2008 through and including August 29, 2008, should be excluded in computing the time within which trial must commence under the Speedy Trial Act, pursuant to 18 U.S.C. § 3161(h)(8)(B)(iv) and Local Code T4 for continuity and preparation of counsel.
