STIPULATION FOR MODIFICATION OF SCHEDULING ORDER AS TO DISCOVERY CUT OFF DATES; ORDER
Plaintiffs by and through their counsel of record and all defendants by and through eir counsel of record stipulate as follows:
STIPULATION FOR MODIFICATION OF SCHEDULING ORDER
1. The parties recently participated in a mediation on December 4, 2008, with uch progress being made. The parties are continuing with settlement negotiations, and are eful that the case can be settled in the near future. The parties informally agreed prior to ediation to refrain from additional discovery until January 4, 2009, in order to avoid curring additional litigation costs and attorney fees, while a potential settlement is being plored.
2. In an effort to allow the parties to effectively explore and negotiate settlement this matter, the parties hereby stipulate, and respectfully request, that the Court modify the heduling Order in this matter as follows:

3. The parties agree that this stipulation may be signed in counterpart.
The parties having stipulated and good cause appearing therefore, IT IS HEREBY RDERED that: (1) the non-expert discovery cutoff date be continued from November 28, to February 13, 2009, (2) the expert designation date be continued from December 19, to February 27, 2009; (3) the supplemental expert designation date be continued from nuary 9, 2009 to March 13, 2009, and (4) the expert discovery cutoff date be continued m January 23, 2009 to March 30, 2009. NO FURTHER CONTINUANCES WILL BE RANTED.
