AMENDED STIPULATION EXTENDING TIME TO RESPOND TO COMPLAINT AND ORDER
IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned, that:
1. Whereas there is a pending motion to deem the above-captioned case related to Eldridge v. Electronic Arts, Inc., Case No. C 08 4733 RMW in the U.S. District Court for the Northern District of California;
2. Whereas a substantially similar new case was filed on November 26, 2008 in the Oakland Division of the U.S. District Court for the Northern District of California*fn1 , and, when served, defendants intend to move to have that case related to Eldridge v. Electronic Arts, Inc.;
3. Whereas plaintiff's counsel in the this matter and Eldridge are discussing a proposed Case Management Order that would contemplate filing a consolidated complaint in these two matters, which would be submitted to this Court by January 23, 2009;
4. Therefore, the time for defendant to respond to the complaint shall be continued until 30 days following the filing and service of any consolidated complaint or denial of the motion to relate. By entering into this stipulation, defendant does not waive any defense to the complaint, including lack of jurisdiction.
