STIPULATION TO DISMISS; AND [PROPOSED] ORDER

Plaintiff and Defendants, by and through their attorneys of record, hereby stipulate, subject to the approval of the Court, to dismissal of the above-entitled action because the United States Citizenship and Immigration Services has adjudicated Plaintiff's application for adjustment of status (Form I-485). The parties further ask that the June 5, 2009 Case Management Conference be vacated.

Each of the parties shall bear their own costs and fees.
