STIPULATION AND [PROPOSED] ORDER VACATING ADMIT/DENY HEARING AND REQUESTING DISMISSAL OF PETITION RE VIOLATION OF SUPERVISED RELEASE
IT IS HEREBY STIPULATED by and between the parties hereto through their respective counsel, ROBERT TICE-RASKIN, Assistant United States Attorney, attorney for Plaintiff, and LINDA C. HARTER, Chief Assistant Federal Defender, attorney for Defendant, that the Admit/Deny Hearing, presently scheduled for April 27, 2009, be vacated.
Counsel for the government and counsel for Mr. Pickett both agree that the petition should be dismissed and the matter dropped from the court's calendar. The parties, with the agreement of the probation officer, have agreed to a modification of the terms of supervision that will be sent to the Court by probation as soon as the final draft is signed.
The parties and probation believe that the modification will address the concerns probation set forth in the petition and is an appropriate resolution of the matter.
