ORDER GRANTING MOTION TO INTERVENE

ORDER

On April 24, 2009, Natural Resources Defense Council and The Bay Institute filed a Motion to Intervene as defendants in this matter. Docket No. 50. The Plaintiffs and Federal Defendants informed the Court during a status conference on May 15, 2009 that they do not oppose this motion.

Therefore, based upon the record and for good cause showing, the Court hereby ORDERS that the motion is GRANTED. Natural Resources Defense Council and The Bay Institute shall be allowed to intervene for all purposes in this litigation as of right pursuant to Fed. R. Civ. P. 24(a). The Proposed Answer lodged by Natural Resources Defense Council and The Bay Institute with their Motion to Intervene shall be filed as the parties' answer.
