STIPULATION TO CONTINUE STATUS CONFERENCE HEARING AND ORDER THEREON

IT IS HEREBY STIPULATED by and between the partieshereto, and through their respective counsel, that the status conference hearing currently set for May 28, 2009 may be continued to July 2, 2009 at 10:00 a.m.

The request is being made because the parties are attempting to resolve the matter and need additional time to discuss offers and for further negotiation. Defense counsel is unavailable from June 11, 2009 through June 29, 2009. The parties agree that the delay resulting from the continuance shall be excluded in the interests of justice, including but not limited to, the need for the period of time set forth herein for effective defense preparation pursuant to 18 U.S.C. §§3161(h)(1)(F), 3161(h)(8)(A), and 3161(h)(8)(B)(i).
