ORDER STRIKING PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT AND DECLARATION

(Docs. 149 and 150)

This is a civil rights action filed pursuant to 42 U.S.C. § 1983 by Plaintiff Charles Chatman, a state prisoner proceeding pro se and in forma pauperis. On June 18, 2009, Plaintiff filed a second motion for summary judgment. (Doc. 149.) As Plaintiff was informed by the Court in its order of June 8, 2009, striking Plaintiff's first motion for summary judgment, the deadline for filing pretrial dispositive motions was December 4, 2007, and this matter is set for jury trial on September 15, 2009. (Docs. 93, 141, 148.) Plaintiff may not move for summary judgment at this stage in the proceedings.

Plaintiff's motion for summary judgment and declaration are HEREBY ORDERED STRICKEN from the record.

IT IS SO ORDERED.
