STIPULATION AND [PROPOSED] ORDER on behalf of their respective clients, that defendants Toshiba America Electronic Components,

White & Case LLP, to accept service of the summons and complaint in the above captioned action on their behalf which service will be effective as of June 8, 2009.

IT IS HEREBY STIPULATED AND AGREED by and among the undersigned counsel, Inc. ("TAEC") and Toshiba America Information Systems, Inc. ("TAIS") authorize their counsel,
