STIPULATION AND ORDER TO CONTINUE SENTENCING

Defendant DIMAS OLIVARES-PENA by and through his attorney James R. Homola, and the united States of America, by and through its attorney, KAREN A. ESCOBAR, Assistant U.S. Attorney, hereby enter into the following stipulation: The parties to this case agree to vacate the June 29, 2009 sentencing date, and to reset the matter for August 17, 2009 at 9:00 am. The continuance is necessary to effectuate the terms of plea agreement.

ORDER

IT IS SO ORDERED. The intervening period of delay is excused in the interests of justice, pursuant to 18 USC §3161(h)(8)(B)(iv).
