GOVERNMENT'S MOTION TO DISMISS WITHOUT PREJUDICE AND ORDER DATE: July 13, 2009 TIME: 10:00 a.m.

Pursuant to Rule 48(a) of the Federal Rules of Criminal Procedure, plaintiff United States of America, by and through its undersigned attorney, hereby moves this Honorable Court for an Order dismissing without prejudice the criminal complaint in the above entitled matter.

ORDER

The government's motion to dismiss the charges without prejudice is granted and defendant is released from federal custody forthwith.

The Clerk of the Court is directed to serve a copy of this order on the United States Marshal.

IT IS SO ORDERED.
