ORDER ACCEPTING REPORT AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE

Pursuant to 28 U.S.C. § 636, the court has reviewed the entire file de novo, including the magistrate judges's report and recommendation. The court agrees with the recommendation of the magistrate judge. The court observes that plaintiff failed to keep the court apprised of his current address. The report and recommendation filed on July 6, 2009 was returned to the court indicating that plaintiff had been "released May 13, 2009 and return to sender no longer at this address."

IT IS ORDERED:

1. The report and recommendation is accepted.

2. Judgment shall be entered consistent with this order.

3. The clerk shall serve this order and the judgment on all counsel or parties of record.
