STIPULATION AND [PROPOSED] ORDER MODIFYING CONDITIONS OF PRETRIAL RELEASE

(In Chambers)

IT IS HEREBY STIPULATED by and between Assistant United States Attorney Philip Ferrari, Counsel for Plaintiff, and Assistant Federal Defender Jeffrey L. Staniels, Counsel for Defendant, that

WHEREAS both counsel have been advised by Pretrial Services Officer Becky Fidelman that Mr. McEwan has tested positive for use of marijuana and for use of cocaine; and

WHEREAS Mr. McEwan remains gainfully employed; and WHEREAS both counsel have conferred with Ms. Fidelman who has recommended under the circumstances that the following modification to the conditions of Mr. McEwan's release be entered as a response to his positive tests;

THEREFORE, both counsel agree to and recommend that the court order that Mr. McEwan's conditions of pretrial release be modified to add the following condition:

"10. You shall participate in a program of medical or psychiatric treatment, including treatment for drug or alcohol dependency, as approved by the pretrial services officer."

IT IS SO STIPULATED.
