STIPULATION TO EXTEND DISCOVERY CUT-OFF AND [PROPOSED] ORDER

WHEREAS, on January 21, 2009, the Honorable Magistrate Judge Elizabeth Laporte issued a Case Management and Pretrial Order for Jury Trial ("Case Management Order");

WHEREAS, on August 25, 2009, the plaintiff Eric Sedie ("Plaintiff") by and through his counsel and the defendant United States ("Defendant") by and through its counsel, (collectively, "the parties") appeared before this Court and agreed to modify the Case Management Order and pretrial schedule as stated below;

WHEREAS, the non-expert discovery cut-off is extended to September 18, 2009, and the expert discovery schedule as follows: initial disclosures are due October 9, 2009, rebuttal expert disclosures are due October 16, 2009 and the expert discovery cut-off is continued to November 10, 2009, and the last day to hear dispositive motions is extended to December 8, 2009 and the parties request an order providing the same.

ACCORDINGLY, it is hereby agreed by the parties, by and through their counsel, that the non-expert discovery cut-off is continued to September 18, 2009, and the expert discovery schedule as follows: initial expert disclosures are due October 9, 2009, rebuttal expert disclosures are due October 16, 2009 and the expert discovery cut-off is continued to November 10, 2009 and the last day to hear dispositive motions is December 8, 2009.
