MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS and (PROPOSED) ORDER
Pursuant to Title 18 U.S.C. §3006A(d)(7) Augustine Gomez through newly appointed counsel, Michael B. Bigelow, asks leave to prosecute his Appeal from the decision of the magistrate judge to the District Court, Eastern District California (Sacramento) without prepayment of fees or costs and to proceed in forma pauperis.
On November 17, 2008, appellant was granted his request for appointed counsel in the underlying matter and on August 25, 2009, undersigned counsel was requested to assume representation and accept appointment on his appeal pursuant to 18 U.S.C. § 3006A(a)(2)(B) of his conviction the district court. Appellant remains unable to afford the assistance of counsel.
