ORDER DIRECTING SERVICE OF PROCESS BY THE UNITED STATES MARSHAL
On November 18, 2009, plaintiff filed a Complaint in forma pauperis under 28 U.S.C. § 1915. Pursuant to Rule 4(c)(3) of the Federal Rules of Civil Procedure, the United States Marshal is directed to proceed with service of process upon the defendant(s) named below only without prepayment of costs, until further order of the Court.
(1) Dr. Yin, only in individual capacity.
A copy of this Order shall be served with the summons and complaint. Upon receipt of this Order, the United States Marshal may request that the defendant(s) waive service. If a waiver of service is not returned by a defendant within thirty (30) days of the date of mailing a request for waiver, the United States Marshal shall personally serve process upon that defendant.
Pursuant to 42 U.S.C. § 1997e(g)(2), defendants are directed to respond to the complaint within the time provided by the applicable provisions of Rule 12 of the Federal Rules of Civil Procedure.
