STIPULATION AND ORDER EXTENDING FOR DEFENDANT TO RESPOND TO PLAINTIFF'S CONFIDENTIAL LETTER

IT IS HEREBY STIPULATED by the undersigned for the respective parties, subject to the approval of the Court, that Defendant shall have until January 11, 2010, to respond to Plaintiff's confidential letter. This extension is requested because Defendant's counsel will be on leave for over two weeks in December and needs additional time to explore the possibility of settlement. Respectfully submitted,

ORDER

Upon the request of the parties, the stipulation is granted. Defendant shall answer Plaintiff' confidential letter no later than January 11, 2010. Plaintiff's opening brief shall be due no later than February 10, 2010. Defendant's opposition shall be filed no later than March 12, 2010. Plaintiff's reply brief shall be due no later than March 29, 2010.
