MOTION TO DISMISS INDICTMENT AND ORDER THEREON

Pursuant to Rule 48 of the Federal Rules of Criminal Procedure, the United States, by and through its undersigned attorney, moves this court for an order dismissing the indictment in the above-captioned matter, case number 2:09-CR-00320-MCE, filed on July 30, 2009.

The defendant pleaded guilty to an information charging a misdemeanor violation of Section 1703(b) of Title 28 of the United States Code, Delay or Destruction of Mail. The defendant was sentenced by Magistrate Judge Gregory G. Hollows on December 14, 2009.
