JUDGMENT AND PROBATION/COMMITMENT ORDER
In the presence of the attorney for the government, the defendant appeared in person on this date. February 22, 2010

X GUILTY, and the court being satisfied that there is a factual basis for the plea. NOLO
There being a finding/verdict of X GUILTY, defendant has been convicted as charged of the offense(s) of: Subscription to False Tax Return in violation of 26 USC 7206(1) as charged in the Single-Count Information The Court asked whether there was any reason why judgment should not be pronounced. Because no sufficient cause to the contrary was shown, or appeared to the Court, the Court adjudged the defendant guilty as charged and convicted and ordered that:
It is ordered that the defendant shall pay to the United States a special assessment of $100, which is due immediately. Pursuant to 18 USC 3663, defendant shall pay restitution in the total amount of $75,362 to victims set forth in a separate victim list prepared by the probation office which this Court adopts and which reflects the Court's determination of the amount of restitution due to each victim. The victim list, which shall be forwarded to the fiscal section of the clerk's office, shall remain confidential to protect the privacy interests of the victims.
Restitution shall be paid in full immediately. The defendant has already tendered the full restitution amount to the Government. These funds shall be applied to this restitution order.
It is ordered that the defendant shall pay to the United States a total fine of $30,000, which shall bear interest as provided
The fine shall be paid in full no later than 60 days from the date of this judgment.
The defendant shall comply with General Order No. 01-05.
Pursuant to the Sentencing Reform Act of 1984, it is the judgment of the Court that the defendant, Yun Jung Han, is hereby placed on probation on Count 1 of the Information for a term of 2 years under the following terms and conditions:
The defendant shall comply with the rules and regulations of the U. S. Probation Office and General Order 318;
The defendant shall perform 150 hours of community service, as directed by the Probation Officer;
During the period of community supervision the defendant shall pay the special assessment, fine and restitution in accordance with this judgment's orders pertaining to such payment;
The defendant shall participate for a period of 10 months in a home detention program which includes electronic monitoring and shall observe all rules of such program, as directed by the Probation Officer;
The defendant shall pay the costs of electronic monitoring to the contract vendor, not to exceed the sum of $12.00 for each day of participation in the electronic monitoring, GPS, and/or voice recognition program. The defendant shall provide payment and proof of payment as directed by the Probation Officer;
The defendant shall truthfully and timely file and pay taxes during the period of community supervision. Further, the defendant shall show proof to the Probation Officer of compliance with this order;
The defendant shall cooperate in the collection of a DNA sample from the defendant; and During the period of probation, the defendant shall make financial records available to the U.S. Probation Office upon request, including all financial records relating to the defendant's car wash business.
