[PROPOSED] ORDER ON STIPULATED MOTION FOR EXTENSION OF TIME TO FILE MOTION TO SUPPRESS AS MODIFIED HEREIN

The Court finds that an extension of time for Defendant to file his Motion to Suppress Evidence two weeks, to March 11, 2010, and for the Government to file any Opposition thereto to April 1, 2010, and an exclusion of time for that period, is warranted because the ends of justice served by the extension outweigh the best interests of the public and the defendant in a speedy trial. See 18 U.S.C. §3161 (h)(7)(A). The failure to grant the requested extension would deny defense counsel the reasonable time necessary for effective preparation, taking into account the exercise of due diligence, and would result in a miscarriage of justice. See 18 U.S.C.

Defendant's reply shall be due on April 8, 2010. The hearing is continued to April §3161(h)(7)(B)(iv).
