IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF CALIFORNIA
April 7, 2010
UNITED STATES OF AMERICA, PLAINTIFF,
MIGUEL A. RUVALCABA, DEFENDANT.
The opinion of the court was delivered by: Gary S. Austin United States Magistrate Judge
AMENDED STIPULATION TO CONTINUE STATUS CONFERENCE HEARING; ORDER DATE: May 6, 2010 TIME: 10:00 a.m.
JUDGE: Honorable Gary S. Austin
IT IS HEREBY STIPULATED by and between the parties hereto, and through their respective attorneys of record herein, that the status conference hearing in the above-entitled matter now scheduled for April 8, 2010, may be continued to May 6, 2010 at 10:00 a.m.
This continuance is requested by counsel for the defendant, as defendant lives in Los Angeles and he is in the process of getting his driving privileges restored by DMV. His plea agreement is contingent upon getting his driving privileges restored. Defendant needs this time to finish the process of restoring his driving privileges. Certified Law Clerk James Hering, on behalf of the United States Attorney's Office, has no objection to this request. The requested continuance will conserve time and resources for both counsel and the court.
No exclusion of time is necessary because this case involves Class B misdemeanors and does not fall within the Speedy Trial Act.

DATED: April 7, 2010 SAMYA BURNEY Staff Attorney Attorney for Defendant Miguel A. Ruvalcaba
