STIPULATION

Plaintiff and counterdefendant Pamela Lee, defendant Kaiser Permanente Flexible Benefits Plan, incorrectly sued as Kaiser Foundation Health Plan Long Term Disability Plan ("Plan"), and real party in interest and counterclaimant Metropolitan Life Insurance Company ("MetLife"), through their respective attorneys, hereby jointly stipulate to the following modification of the current briefing and hearing schedule with regard to the parties' respective motions for judgment, in light of the need for the parties to complete certain pending discovery procedures:

Plaintiff's opening brief due June 25, 2010

Defendants' opposition and cross motion due: July 9, 2010

Plaintiff's reply and opposition to cross motion due: July 23, 2010

Defendants' reply due: July 30, 2010

Hearing on cross motions: August 6, 2010, or the earliest date thereafter that is convenient to the Court
