United States v. Todd

UNITED STATES DISTRICT COURT EASTERN DISTRICT OF CALIFORNIA

May 12, 2010

UNITED STATES OF AMERICA, PLAINTIFF,
v.
SARAH RENEE TODD, DEFENDANT.

The opinion of the court was delivered by: Judge Hon. Lawrence J. O'Neill

STIPULATION TO CONTINUE STATUS CONFERENCE & MOTIONS HEARING; ORDER Date: June 4, 2010 Time: 9:00 a.m.

IT IS HEREBY STIPULATED by and between the parties hereto, and through their respective attorneys of record herein, that the status conference and motion hearing in the above-referenced action now scheduled for May 13, 2010, may be continued to June 04, 2010 at 9:00 a.m.

This continuance is requested by the parties as United States Attorney, Mark J. McKeon, is presently in trial and anticipates being in trial through the following week. The parties believe that a resolution of the case is possible; however, we have not been able to have sufficient negotiations in that regard. Parties agree that time should be excluded through June 4, 2010.

The parties agree that the delay from the continuance shall be excluded in the interest of justice, including but not limited to, the need for the period of time set forth herein for further preparation pursuant to 18 U.S.C. §§ 3161(h)(7)(A) and (B)(iv).

Dated: May 11, 2010

ORDER

Good cause exists for the requested continuance, and it is GRANTED. The intervening period of delay shall be excluded in the interests of justice pursuant to 18 U.S.C. §§ 3161(h)(7)(A) and 3161(h)(8)(B)(iv).

IT IS SO ORDERED.
