ORDER DETAINING MATERIAL WITNESS
On Court's own motion, in a case allegedly involving a serious risk that the material witness will flee and further obstruct or attempt to obstruct justice.
The Court finds that no condition or combination of conditions will reasonably assure the appearance of the material witness as required by this Court.
The Court has considered the nature and circumstances of the offense charged, representations by her family member appearing before this Court, the age of the material witness, as well as the age and dependancy of her minor child.
The Court has further considered all the evidence provided at the detention hearing and the arguments and/or statements of counsel, and the Pretrial Services Report/recommendation.
IT IS THEREFORE ORDERED that the material witness be detained until Friday May 21, 2010, at 7:30 a.m., unless a verdict is reached before that date and time, in the above-captioned criminal matter.
IT IS FURTHER ORDERED that the minor material witness be committed to the custody of the Orange County Juvenile Hall up to and including the date and time her presence is required in this Court.
IT IS FURTHER ORDERED that the material witness be afforded reasonable opportunity for private consultation with counsel.
IT IS FURTHER ORDERED that the material witness shall be transported by the United States Marshal to and from all appearances in connection with this court proceeding to be held at United States District Court Central District of California Ronald Regan Federal Building, Courtroom 9D, 411 West Fourth Street., Santa Ana, CA 92701-4516.
