STIPULATION AND ORDER TO ADD AN AFFIRMATIVE DEFENSE TO DEFENDANT ALLSTATE INDEMNITY COMPANY'S ANSWER

IT IS HEREBY STIPULATED by and between John Tucker and Allstate Indemnity Company, by and through their respective attorneys of record, that Allstate may amend its answer in this case to include a thirty-sixth affirmative defense for "advice of counsel," which reads as follows:

The Complaint, and each purported cause of action in the Complaint, is barred because Allstate relied on the advice of its legal counsel, McCormick Barstow LLP.
