STIPULATION AND ORDER FOR CONTINUANCE OF MAY 28, 2010 CASE MANAGEMENT CONFERENCE

Plaintiff and Defendants, by and through their respective counsel, hereby stipulate and respectfully request:

WHEREAS the Plaintiff has signed the settlement agreement;

WHEREAS the Defendants are still gathering one signature for the settlement agreement and the settlement checks;

WHEREAS this case is currently set for a case management conference on May 28, 2010 at 10:30 a.m. before the Honorable Judge Ronald M. Whyte;

WHEREAS the parties agree to a 56 day continuance of the case management conference so as to finalize settlement;

NOW THEREFORE, IT IS HEREBY STIPULATED, AGREED AND REQUESTED by and between the parties, by and through their respective undersigned counsel, that the Court vacate the May 28, 2010 case management conference and continue it to July 23, 2010.
