United States v. Davis

IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF CALIFORNIA

June 22, 2010

UNITED STATES OF AMERICA, PLAINTIFF,
v.
TRENT MARK DAVIS, DEFENDANT.

The opinion of the court was delivered by: Morrison C. England, Jr. United States District Judge

STIPULATION AND ORDER CONTINUING CASE. Date: June 24, 2010 Time: 9:00 a.m. Judge: Hon. Morrison C. England, Jr.

IT IS HEREBY STIPULATED by and between Assistant United States Attorney Robert Tice-Raskin, counsel for Plaintiff, and Assistant Federal Defender Jeffrey L. Staniels, counsel for Defendant that the above case be vacated from this court's June 24, 2010, calendar, that it be continued until August 26, 2010, at 9:00 a.m. for judgment and sentencing proceedings. Since Mr. Davis previously pled guilty time exclusions under the Speedy Trial Act are not needed.

This continuance is needed to complete submissions to the Probation Office which were not completed due to a miscommunication regarding sentencing related financial information which Mr. Davis sent to counsel but which counsel apparently misplaced and did not forward to Probation. This continuance will also permit Mr. Davis to obtain an affordable ticket to fly from New Orleans to Sacramento for court.

IT IS SO STIPULATED.

Dated: June 15, 2010

ROBERT TICE-RASKIN Assistant United States Attorney Counsel for Plaintiff

ORDER

IT IS SO ORDERED.
