For the reasons set forth in the government's Motion to Dismiss, filed June 14, 2010, specifically that:

(1) defendant is not in state, not federal, custody and his petition is not ripe; and

(2) defendant's Parole Commission warrant, filed June 29, 2005, is prima facie valid;

IT IS HEREBY ORDERED THAT defendant's Motion for Relief pursuant to 28 U.S.C. § 2241 is DISMISSED.
