EXPARTE ORDER EXTENDING DATE FOR FILING DATE FOR MOTION TO QUASH
Pursuant to Federal Rules of Civil Procedure, Rule 144, and for the reasons stated in the Ex Parte Motion filed in this Court by Deputy Attorney General Carol Hinkle Sanchez, counsel representing Child Protective Services, and for good cause shown, the Court hereby orders as follows:
1) The Ex Parte Motion filed by counsel for Child Protective Services is hereby granted allowing for the extension of time so that counsel may secure Pro Hac Vice admission to this Court in order to allow counsel to file any motion or responsive pleadings in this matter;
2) Section 6 of the Order executed by this Honorable Court on August 4th, 2010, requiring any motion to quash a subpoena duces tecum be filed no later than August 26th, 2010, is hereby vacated, and such date shall be extended, and any motion to quash a subpoena duces tecum issued pursuant to the Order of August 4th, 2010, shall be filed under seal, and served only upon counsel for defendant, James Ninete Leon Guerrero, no later than September 9th, 2010, and shall be noticed for hearing before Magistrate Judge Gary S. Austin on September 17, 2010, at 9:30a.m. Counsel for any party moving to quash a subpoena duces tecum issued pursuant to this Order may appear telephonically as arranged through the Clerk to Magistrate Austin.
3) All other orders shall remain in full force and effect.
