JUDGMENT FOLLOWING ORDER GRANTING MINE SAFETY APPLIANCES CO.'S F.R.C.P. 12(b)(6) MOTION TO DISMISS WITH PREJUDICE
On July 21, 2010, this Court granted Defendant Mine Safety Appliances Co.'s ("MSA") Federal Rule of Civil Procedure 12(b)(6) Motion to Dismiss Plaintiffs Casden Builders Inc. and Casden Glendon LLC's entire Complaint against MSA and each claim for relief alleged therein against MSA.
IT IS THEREBY ORDERED, ADJUDGED AND DECREED that the Complaint of Plaintiffs Casden Builders Inc. and Casden Glendon LLC be dismissed in its entirety, with prejudice, as to MSA, that Plaintiffs shall take nothing from their Complaint, and that MSA shall be entitled to recover its costs.
